The second factor that we would look at after your medical documentation that we talked about in video one is your age. People over the age of 50 have a different set of rules or different operating regulations that they fall into. (over 50 should call a disability lawyer BEFORE they apply) That becomes even more important if you have had a history of physical work.

Your Relevant Work History is what Social Security calls your work history what you’ve done for the last 15 years before you claim you became disabled. If you have kind of a limited education, maybe high school or less, have done manual labor, maybe worked in a factory, you’re going to have a very different case than somebody that is under the age of 50. The younger you are the more medical records, the more documentation you’re going to need.

Anybody over the age of 50 should probably talk to a social security disability lawyer. It’s very important to understand that the older you are, Social Security recognizes that you’re going to have a lot more difficulty transitioning to different type of work than what you might have done in the last 15 years.

If you’re under 50, if you’re 25 or 30, or 35 or 40 even, there’s all jobs are on the table for you and you must show that you cannot do any job. Out of over 12,000 different types of jobs that they say exist in the national economy, you have to show that you can’t do any of them. Even if that job may only pay you minimum wage, which is a fraction of what you were making before. You have to show that you still couldn’t do that job consistently, eight hours a day, five days a week, every day without needing what we call ‘special accommodations’. Extra breaks, lighter duties, those types of thing.
