First thing you need to do is assess the situation, stay calm. If necessary call for an ambulance. Otherwise you should call the police. While you’re waiting for the police you should get information from any witnesses or we’re sticking around for a few minutes because they may want to leave, if necessary use your phone, take a photograph of their car and their license plate. You want to photograph the scene of the accident as much as possible. You cannot take too many pictures.
Immediately after that make sure those pictures are safe in the cloud or print them off or put them somewhere safe so if you lose your phone you don’t lose your evidence.
You want to exchange information with the driver that hit you and make them give you, their insurance card take a picture of it, their drivers license take a picture of them especially if that person is not the same person that shown on the insurance card or if they show a drivers license and it looks absolutely nothing like it, happens sometimes it is rare but it does happen.
You cannot have too many photographs from every angle that you can think of. After that you want a visit with your doctor as quickly as you can, everyday that you wait can hurt your case.
You do not need to talk to the at-fault driver’s insurance adjuster but you should report the accident to your insurance, if the guy doesn’t have insurance or something you want to make sure your insurance company knows that there was an accident. But you do not need to give a recorded statement to the at-fault drivers insurance, you probably shouldn’t give a recorded statement to your insurance for that matter, but you need to find out where you are physically before you decide to proceed too far one way or another.
