Be honest with yourself before filing for disability in Missouri.

Social Security Administration Administrative Law Judges (ALJ) do expect you to exhaust all available options and for you not to simply assume you are disabled from working. They expect that if you undergo surgery, follow all of your doctor’s orders. The ALJ”S want to see that you tried to rehabilitate yourself and try to return to some sort of work even if you are earning significantly less money and the job is very boring.

ALJ will ask you if you have tried to work after a surgery or course of treatment.  You have a significantly greater chance of winning disability benefits if you can show one or more unsuccessful work attempts, your medical records show frequent doctor’s visits and you followed the doctor’s prescribed treatment.

While it is true that not every surgery will get you back to 100%, many surgeries will work well enough to allow you to return to work if you follow through with post surgical physical therapy, stop smoking, do your home exercise program, lose weight and such.

By contrast if your medical records only document a surgery (or worse, you wouldn’t have the surgery), very little in the way of follow up and no effort to try to work, your ALJ may conclude that you have given up and simply don’t want to work.  This is very bad in this current climate where disability hearing approvals in Springfield Missouri are now below half of the national average, your ALJ may very well decide that you are not a credible claimant and that you have not tried hard enough to stay off Social Security disability.
