Missouri Social Security and Driving restrictions

Something I hear a lot of in my practice as a Missouri Social Security Lawyer is “I can’t work because I can’t drive or “I’m disabled because no one will hire someone in my condition” Unfortunately, these is not factors that a Social Security Disability ALJ will take into consideration.  The SSA presumes that you either live in an area in which public transportation is available or that you will move if that is all that is holding you back from working.  Now, if your conditions and impairments keep you from being able to take public transportation, that is something that will benefit your disability claim.  The problem for most folks that live in Southwest Missouri and Northwest Arkansas is public transportation is very limited and the economy continues to struggle, especially in many of the factory and labor intensive jobs that many of my clients have had in the past.

In all Social Security disability cases, the person seeking benefits has the burden of proving that they cannot reliably work (i.e. 8 hours a day, 5 days a week) any simple, entry-level job was available.   Other issues – such as your local economy has a very poor job market or any job you can get is significantly less than your prior work and the pay would support your family are not relevant to your case.
