What should you do if you are injured in a Missouri Work Accident?

What should you do if you are injured in a Missouri work accident?  Missouri Workers Compensation Law provides that the employee must give the employer written notice of the injury within thirty (30) days of the date of accident (or occupational disease and repetitive motion cases, thirty (30) days of diagnosis. Write your name and address, the date, time, place, and type of injury, and give it to somebody in management, not just a fellow employee. Keep a copy.  If you have concerns that it is not being reported by your manager.  Send a fax, email or certified letter and keep copies, including proof of delivery.  When your employer learns that you have been injured, they are required to file a Report of Injury with the Division of Workers’ Compensation so long as the injury has resulted in either lost time from work or at least $500.00 in medical care.

You only have to report the accident to your employer.  There is no requirement that you have to sign the Report of Injury  your employer files with the Missouri Division of Workers’ Compensation. If you are asked by your employer to complete or sign a Report of Injury, make sure that it is  accurate and read it carefully before signing it.  Make sure that you are provided a copy. Do not answer questions or sign statements that are unrelated to the accident.

You should also ask if there is a certain medical doctor or facility you should go to.  If they tell you there isn’t, ask to have that confirmed in writing before you go to a doctor if possible.

You should also keep a pain and treatment journal to track your progress and help your attorney.  You should then call a Missouri Workers Compensation attorney as soon as possible.
