Common Social Security Disability Questions from KY3 Call a Lawyer Part 3

I was asked to sit on the Springfield Missouri Bar Association Call a Lawyer program on KY3. We took a lot of calls from all over Southwest Missouri about Social Security Disability. There were some common disability questions or complaints that I heard several times. I will try to answer some of them over the next few posts.

Common Question #3

Should I apply for disability benefits?

A. Yes if you have a medical condition that is severe enough to prevent you from working and earning over $1,040 a month in 2013 , $1070 in 2014 and $1,090 in 2015 and is expected to keep you from working for a period of at least 12 continuous months, then you should apply right away. You do not have to wait a year to apply. If you truly believe you will not be able to work in that year period you should apply for disability benefits sooner than later.

Applying soon is especially important if you have not worked for several years because of your problems for lots reasons. The main reason is if you wait too long, you may not be insured under the Social Security Disability Program (SSD). It is an insurance program and your Social Security taxes are your premium.
