If I’m 100% VA disabled, do I automatically get Social Security Disability Benefits in Missouri or Arkansas?

Hello. This is Springfield Missouri Disability Attorney Jason Krebs. In today’s video, I thought we’d answer the question, if I’m 100% VA disabled, do I automatically get Social Security Disability Benefits in Missouri or Arkansas?

Unfortunately, the answer to that is no. You’re going to need to be able to show that you qualify under the Social Security Administration Regulations regarding disability. That means basically, you’re going to need to be able to show that there’s no work that you can do out of all the jobs in the United States economy. Basically, if there’s no work that you could do, then you’re going to have a pretty good case.

Now, if you’re over the age of 50, that gets a little more complicated and you have some advantages under the law that you don’t want to start down the process without speaking to an attorney first. For most folks, you’re going to have to show that there’s no work that you can do out of all the jobs, different types of jobs, that exist in the United States economy.

Now, Social Security does have to take into account your VA rating and what the VA has found. Typically, the VA medical records are going to have some good things in there. We hope that they would have some good things in there that would support your rating and how it’s going to affect your ability to show up to work in the civilian setting every day, eight hours a day, five days a week, or the rough equivalent, four 10-hour days, that sort of thing.

Now, most folks … This goes also, before I forget, this goes also for if you are less than 100% VA disabled, but then you have significant other things going on that are non-service related, this would apply for you as well. It’s real important to understand that you’re going to still have to be able to show that there’s no work that you’re going to be able to do.

Social Security does not do percentages of disability like the VA does; the 10, 20, 50, 70, whatever, 100%. With Social Security disability, it is an all or nothing proposition. It’s 100% or zero. You need to really make sure that you have a lot of documentation, that you’re going to the doctor frequently, and documenting before you start down this process.
